Sad thing, this cretin may get away with it as Pennsylvania's age of consent is 16 and consent is going to be a sticking point.  Also at issue is whether Jack is considered an "authority figure".  If he is found to be in a position of authority he can be charged under the statutory rape sections. If he is not deemed to be in authority then the other sections of the law must be applied.  My gut tells me he knew all this prior to said incident and this girl was being "groomed".

In January, the complaint said, Mr. Jack began regularly texting the girl, making her feel uncomfortable.

Documents show that Mr. Jack set up a Google account for both of them using fake names and gave her a second cell phone so their conversations could be private.

The complaint said that at some point before Easter, Mr. Jack took the girl to his parents’ house in Lower Burrell and introduced the idea that the two should have sex. He began kissing and touching the girl, but she started crying and refused to do anything more, the complaint said.

Some time later, Mr. Jack again told the girl that they should have sex. When the girl refused, the criminal complaint said Mr. Jack forcefully held her on the floor and raped her.

The criminal complaint said that Mr. Jack had sex with the girl about six times from shortly before Easter to the end of April.

The girl did not object to having sex after the first time, she told police, because she looked up to Mr. Jack as a mentor and father figure and didn’t want to disappoint him.

But Robert Mielnicki, Mr. Jack’s attorney, said that he has collected some information inconsistent with forcible rape, including a letter from the girl.
